2026 Arrives with No Fee Increases and New Subsidies in Industrial Property

In a context marked by the extension of the General State Budget, many of you as clients have been asking us how this situation affects official fees and subsidies in the field of industrial property. Below, we explain the current situation in a clear and practical way.

Official Fees Remain Unchanged

The absence of new General State Budgets means that the OEPM’s official fees have not been updated. This means there is no fee increase for trademarks, trade names, patents or utility models, and the same amounts as in the previous financial year continue to apply. There are also no automatic inflation-linked increases or upward revisions. In practice, this situation provides stability and predictability for companies and entrepreneurs who are planning applications or renewals in 2026.

Subsidies Will Continue in 2026

Unlike fees, subsidies do not depend directly on the approval of the General State Budgets, but on the existence of a regulatory framework order and an annual call for applications published by the competent authority. For this reason, subsidies are expected to be available in 2026, although their publication may be slightly delayed compared to other years.

When Will the Calls for Applications Be Published?

OEPM Subsidies: The OEPM’s grants for promoting patent and utility model applications, both in Spain and abroad, are usually published during the first half of the year. For 2026, the forecast is that the call will be published between February and May, by way of an extract in the Official State Gazette (BOE) and the corresponding announcement in the National Subsidies Database. These grants typically subsidise official fees and certain technical procedures, and are aimed primarily at SMEs, natural persons and certain private entities.

SME Fund – EUIPO: As a complementary measure, the European Union Intellectual Property Office, EUIPO, will once again launch the SME Fund in 2026. The opening of this call is scheduled for early February 2026 and will, once again, allow recovery of part of the costs associated with EU trademarks and designs, intellectual property diagnostic reports and other European procedures.

At the same time, subsidies are expected to be called again in 2026, both at national level through the OEPM and at European level through the EUIPO’s SME Fund.
